Welcome to Hawaii Ocean Rafting. By accessing our website at hawaiioceanrafting.com, booking a tour, or participating in any of our ocean excursions, you agree to be bound by the following Terms and Conditions. Please read them carefully before making a reservation.

Booking and Reservations

All tour bookings are processed through our authorized booking platform, FareHarbor. By completing a reservation, you agree to FareHarbor’s terms of service in addition to these Terms and Conditions.

  • Reservations are confirmed upon receipt of full payment.
  • All prices are listed in U.S. dollars and are subject to applicable taxes and fees.
  • Tour availability is subject to change without notice. We reserve the right to modify schedules, itineraries, and pricing at any time.

Cancellation and Refund Policy

We understand plans can change. Our cancellation policy is as follows:

  • Cancellations made 24 hours or more before the scheduled departure time are eligible for a full refund.
  • Cancellations made less than 24 hours before departure are non-refundable.
  • No-shows are non-refundable.
  • Refunds are processed through the original payment method and may take 5–10 business days to appear.

Please refer to the specific cancellation policy listed on your tour confirmation, as certain tours may have different cancellation windows.

Weather and Trip Modifications

The safety of our guests and crew is our top priority. Hawaii Ocean Rafting reserves the right to:

  • Cancel, delay, or modify any tour due to weather conditions, ocean swells, or other safety concerns.
  • Alter tour routes or itineraries at the captain’s discretion based on real-time conditions.
  • Substitute vessels when necessary for operational or safety reasons.

In the event of a weather-related cancellation by Hawaii Ocean Rafting, guests will be offered a full refund or the option to reschedule at no additional cost.

Participant Requirements

  • Minimum Age: Age requirements vary by tour. Please check the specific tour listing for minimum age restrictions.
  • Health and Fitness: Participants should be in reasonable physical health. Our ocean rafts involve exposure to sun, wind, waves, and ocean spray. Guests with back or neck problems, recent surgeries, heart conditions, or who are pregnant should consult a physician before booking.
  • Swimming Ability: While life jackets are provided, basic swimming ability is recommended for snorkel tours.
  • All participants (or their legal guardians for minors) must sign a liability waiver prior to boarding.

Assumption of Risk and Liability Waiver

Ocean activities involve inherent risks including but not limited to: rough seas, marine life encounters, sun exposure, seasickness, and equipment-related incidents. By participating in any Hawaii Ocean Rafting tour, you acknowledge and voluntarily assume all risks associated with the activity.

To the fullest extent permitted by law, Hawaii Ocean Rafting, its owners, employees, and agents shall not be held liable for any injury, loss, damage, or expense arising from participation in our tours, except in cases of gross negligence or willful misconduct.

Guest Conduct

We are committed to providing a safe and enjoyable experience for all guests. We reserve the right to refuse service or remove any guest from a tour without refund if their behavior:

  • Endangers the safety of themselves, other guests, or crew
  • Is disruptive, abusive, or in violation of crew instructions
  • Involves intoxication from drugs or alcohol
  • Violates federal, state, or local laws

Marine Life and Environmental Responsibility

Hawaii Ocean Rafting operates under all applicable federal and state regulations regarding marine wildlife, including the Marine Mammal Protection Act and the Endangered Species Act. All guests must:

  • Follow crew instructions regarding safe distances from marine animals
  • Refrain from touching, feeding, or harassing any wildlife
  • Not remove any coral, shells, or marine organisms from the ocean
  • Dispose of all trash properly — nothing goes overboard

Wildlife sightings (including whales and dolphins) are natural occurrences and cannot be guaranteed.

Photography and Media

By participating in a Hawaii Ocean Rafting tour, you grant us permission to use photographs and video taken during the tour for marketing, social media, and promotional purposes unless you notify us otherwise prior to departure.

Gift Certificates and Passes

  • Gift certificates and Ali‘i Whale Watch Passes are non-refundable and non-transferable unless otherwise stated.
  • Gift certificates must be redeemed within the timeframe specified at purchase.
  • Lost or stolen certificates cannot be replaced.

Intellectual Property

All content on hawaiioceanrafting.com — including text, images, logos, graphics, and videos — is the property of Hawaii Ocean Rafting and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our prior written consent.

Third-Party Links

Our website may contain links to third-party websites for your convenience. Hawaii Ocean Rafting is not responsible for the content, accuracy, or privacy practices of external sites.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Hawaii. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Maui County, Hawaii.

Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or services constitutes acceptance of the revised terms.
